Terms of Service

1. Parties and Agreement
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Altream Sdn Bhd(formerly known as Streamz Holding Sdn Bhd), a company incorporated under the laws of Malaysia (SSM Registration No: 202501005010 (1606424-P)) ("Altream," "we," "us," or "our"), the operator of the NeurometriX platform.
By accessing, browsing, or using the NeurometriX platform, website, APIs, and any related services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Services on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms, and references to "you" shall include that organisation.
Age Requirement: You must be at least 18 years of age to use the Services. By agreeing to these Terms, you represent and warrant that you are at least 18 years old. If you are under 18, you may not access or use the Services under any circumstances.
If you do not agree to these Terms, you must not access or use the Services. Your continued use of the Services following any updates to these Terms constitutes acceptance of the revised Terms.
2. Services
NeurometriX is a neuroscience-based talent assessment platform designed to help organisations make fair, data-driven hiring decisions. The Services include, but are not limited to:
- Game-Based Cognitive Assessments: A suite of scientifically designed cognitive games that measure traits such as attention, memory, decision-making, adaptability, risk tolerance, and emotional processing.
- AI-Powered Trait Scoring: Proprietary algorithms that analyse game interaction data to generate multi-dimensional cognitive trait profiles for candidates.
- Benchmark Profile Builder: Tools enabling employers to define ideal cognitive trait profiles for specific roles and compare candidates against those benchmarks.
- Candidate Management: Dashboard tools for inviting candidates, tracking assessment progress, reviewing results, and comparing candidate profiles.
- Reporting and Analytics: Detailed reports, score visualisations, and exportable data to support hiring workflows.
We reserve the right to modify, update, or discontinue any aspect of the Services at any time with reasonable notice to active subscribers.
3. Accounts
Employer Accounts
Employer accounts are created by organisations to access the full suite of hiring and assessment tools. The organisation that creates the account is responsible for all activity conducted under that account, including the actions of any team members granted access. Each employer account is associated with a single organisation, and the platform operates on a multi-tenant architecture ensuring strict data isolation between organisations.
Candidate Accounts
Candidates access assessments via magic link invitations sent by employer organisations. Candidate accounts are created automatically upon first access and are scoped to the inviting organisation's tenant. Candidates do not require a password; authentication is handled through secure, time-limited magic links.
Account Responsibilities
- You must provide accurate, current, and complete information during registration and keep your account information updated.
- Each account may be associated with only one organisation. You may not share accounts across multiple organisations.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- You must notify us immediately of any unauthorised use of your account at security@neurometrix.io.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for unauthorised purposes.
4. Subscription & Payment

The Services are offered under the following subscription plans:

Payment Terms
- All fees are quoted and payable in United States Dollars (USD) and are processed via Stripe. Payments are processed by Upstream BPO Sdn Bhd on behalf of Altream Sdn Bhd. Your card statement may show "NEUROMETRIX" or "UPSTREAMBPO".
- Fees are billed in advance on a monthly or annual basis, depending on your selected billing cycle.
- Malaysian Sales and Service Tax (SST) may apply in addition to the stated subscription fees, where required under Malaysian law.
- New paid subscriptions include a 14-day free trial. You will not be charged until the trial period ends. You may cancel at any time during the trial without charge.
Cancellation and Refunds
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and you will retain access to the Services until that date.
- Monthly subscriptions are non-refundable. Pro-rata refunds for annual subscriptions may be issued at Altream's sole discretion upon written request.
- We reserve the right to change pricing with 30 days' advance notice. Price changes apply at the start of your next billing cycle.
- If payment fails, we will attempt to process payment again. If payment continues to fail after reasonable attempts, your account may be suspended until payment is resolved.
5. Acceptable Use
You agree to use the Services in a lawful, responsible, and ethical manner. The following activities are strictly prohibited:
Prohibited Activities
- Public Sharing of Assessment Links: Assessment invitation links are confidential and must not be shared publicly, posted on social media, job boards, or any publicly accessible platform. Links are intended for specific, invited candidates only.
- Reverse Engineering Scoring: You must not attempt to reverse engineer, decompile, disassemble, or otherwise derive the underlying scoring algorithms, trait models, or proprietary methodologies used by the platform.
- Sole Basis for Hiring: Assessment results must not be used as the sole or determinative basis for any hiring, promotion, or employment decision. Results are designed to supplement, not replace, human judgment and comprehensive evaluation processes.
- Discrimination: You must not use assessment data, results, or the Services to discriminate against any candidate on the basis of race, colour, religion, sex, gender identity, sexual orientation, national origin, age, disability, marital status, or any other characteristic protected by applicable law.
- Violation of Employment Laws: You must comply with all applicable employment, labour, and anti-discrimination laws in your jurisdiction when using the Services and assessment results.
Additionally, you agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable laws or regulations.
- Interfere with or disrupt the Services, servers, or networks connected to the Services.
- Use automated means (bots, scrapers, crawlers) to access the Services without our prior written consent.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Upload or transmit any malicious code, viruses, or harmful content.
Violation of this Acceptable Use policy may result in immediate suspension or termination of your account without refund.
6. Data & Privacy
Our collection, use, storage, and protection of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you acknowledge that you have read and understood our Privacy Policy.
Data Ownership
You retain full ownership of all data you upload to or create using the Services ("Your Data"). We do not claim ownership of Your Data. You grant Altream a limited, non-exclusive licence to process Your Data solely for the purpose of providing and improving the Services.
Data Processing Agreement
For enterprise customers and where required by applicable data protection laws (including GDPR, PDPA, and equivalent regulations), Altream will enter into a Data Processing Agreement (DPA) that governs the processing of personal data on your behalf. DPA terms are available upon request.
No Data Selling
Commitment: Altream does not sell, rent, lease, or trade your personal data or assessment data to any third party. Your data is used exclusively to provide the Services and is never monetised independently.
7. Assessment Science Disclaimer
Important Disclaimer
NeurometriX assessments are designed to support and inform hiring decisions, not to replace human judgment. Assessment results should be used as one component of a comprehensive, multi-factor evaluation process.
- No Guaranteed Outcomes: NeurometriX does not guarantee that the use of our assessments will result in successful hires, improved employee performance, or any specific business outcome. Results are probabilistic indicators based on cognitive science research, not deterministic predictions.
- Supplementary Tool: Our assessments are intended to supplement traditional hiring methods such as interviews, reference checks, skills testing, and background verification. They should never be the sole factor in any employment decision.
- Legal Compliance: It is your responsibility to ensure that your use of cognitive assessments complies with all applicable employment laws, anti-discrimination statutes, and regulations in your jurisdiction. This includes, but is not limited to, the Employment Act 1955 (Malaysia), EEOC guidelines (United States), Equality Act 2010 (United Kingdom), and equivalent legislation worldwide.
- Reasonable Accommodations: You are responsible for providing reasonable accommodations to candidates with disabilities, in accordance with applicable law, when administering assessments through the platform.
- Scientific Basis: Our assessment methodologies are grounded in peer-reviewed cognitive neuroscience research. However, no psychometric tool is infallible, and Altream does not warrant the accuracy of individual results for any specific candidate.
8. Intellectual Property
Platform Ownership
All intellectual property rights in the Services, including but not limited to software, source code, algorithms, game designs, scoring models, user interface designs, trademarks, trade names, logos, documentation, and all related content, are exclusively owned by Altream Sdn Bhd or its licensors. These Terms do not transfer any ownership rights to you.
Your Data
You retain full ownership of all data you upload, create, or input into the Services. Altream claims no intellectual property rights over Your Data.
Assessment Results
Assessment results, trait scores, and reports generated through the platform belong to the employer organisation whose tenant initiated the assessment. Candidates may request access to their own results in accordance with applicable data protection laws.
Restrictions
- You may not copy, reproduce, distribute, resell, sublicence, or create derivative works based on any part of the Services or its underlying technology.
- You may not use the NeurometriX name, logo, or trademarks without prior written consent from Altream.
- You may not extract, scrape, or systematically download data from the platform for purposes other than your authorised use.
9. Liability Limitation
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED UNDER THE LAWS OF MALAYSIA, ALTREAM SDN BHD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, WHETHER ARISING FROM CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE.
Hiring Decisions
Altream is not liable for any hiring decisions, employment outcomes, or consequences arising from the use of assessment results. The responsibility for all hiring decisions rests solely with the employer organisation.
Liability Cap
Altream's total aggregate liability for any and all claims arising from or related to these Terms or the Services shall not exceed the total fees paid by you to Altream during the three (3) months immediately preceding the event giving rise to the claim.
Service Provided "As Is"
The Services are provided on an "as is" and "as available" basis. While Altream takes reasonable care to ensure the platform functions reliably and accurately, we do not warrant that the Services will be uninterrupted, error-free, or free from defects. All implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement, are disclaimed to the maximum extent permitted under Malaysian law.
Force Majeure
Altream shall not be liable for any failure or delay in performance resulting from events beyond our reasonable control, including but not limited to natural disasters, government actions, pandemics, internet outages, or third-party service failures.
10. Governing Law & Disputes
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.
Dispute Resolution
- Amicable Resolution: In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Services, the parties shall first attempt to resolve the matter amicably through good-faith negotiation within thirty (30) days of written notice of the dispute.
- Arbitration: If the dispute cannot be resolved amicably within the 30-day period, it shall be referred to and finally resolved by arbitration administered by the Kuala Lumpur Regional Centre for Arbitration (KLRCA) in accordance with its arbitration rules in force at the time of the dispute.
- Seat of Arbitration: The seat of arbitration shall be Kuala Lumpur, Malaysia.
- Language: All arbitration proceedings shall be conducted in the English language.
- Binding Decision: The arbitral award shall be final and binding upon both parties and may be enforced in any court of competent jurisdiction.
11. Termination
Termination by You
You may terminate your account at any time by providing thirty (30) days' written notice through your account settings or by contacting us at legal@neurometrix.io. Cancellation takes effect at the end of the notice period, and you will retain access to the Services until that date.
Termination by Altream
We may terminate or suspend your access to the Services immediately, without prior notice, if:
- You materially breach any provision of these Terms.
- You engage in activity that we reasonably believe is fraudulent, harmful, or otherwise detrimental to the platform or other users.
- Required by law, regulation, or legal process.
Data Export After Termination
Data Retention: Following termination of your account, Altream will retain your data for a period of thirty (30) days, during which you may request an export of Your Data in a standard, machine-readable format. After this 30-day period, your data will be permanently deleted unless retention is required by applicable law.
Termination does not relieve you of any obligation to pay outstanding fees or of any liability for actions taken prior to termination. Provisions of these Terms that by their nature should survive termination (including Sections 6, 7, 8, 9, and 10) shall survive.
